General Sales Conditions

ARTICLE 1 : PREAMBLE

ARTICLE 2 : PURPOSE

These conditions govern the sales by the company LE GRAND SIECLE, 10 Rue de Montigny, 13100 Aix-en-Provence - France of products and decorative objects.

ARTICLE 3 : PRICE

The prices of our products are indicated in euros all taxes included (VAT and other taxes applicable on the day of the order), unless otherwise indicated, and excluding processing and shipping costs. In the case of an order issued from a country other than metropolitan France, the buyer is considered the importer of the product or products concerned. Customs tariffs or other local taxes or import duties or state taxes may be due. LE GRAND SIECLE disclaims all responsibility for any of these tariffs and duties. They will be the sole responsibility of the buyer, as the importing party, both in terms of declarations and payments to the competent authorities, and instituions of his/her country. All orders, regardless of their origin, are payable in euros. LE GRAND SIECLE reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the price list in force at the time of validation of the order, subject to availability. The products remain the property of LE GRAND SIECLE until full payment of the price. Attention: as soon as the buyer physically takes possession of the ordered products, the risk of loss or damage to the products is transferred to him/her.

ARTICLE 4 : ORDERS

The buyer can place an order on the website www.legrandsiecle.com. The sales terms and conditions of sale are presented in French, and are confirmed by the buyer at the time of validation of the order. LE GRAND SIECLE reserves the right not to record a payment, and not to confirm an order for any reason whatsoever, and more particularly in the event of supply problems, or in the event of a difficulty concerning the order received.
 

ARTICLE 5 : ORDER VALIDATION

Any order appearing on the website www.legrandsiecle.com implies acceptance of these Sales Terms and Conditions by the buyer. Any order confirmation implies the buyer’s full and complete understanding, and acceptance, of these sales terms and conditions of sale, without exception or reservation. All the data provided and the recorded confirmation will be deemed proof of the transaction. The order confirmation shall be deemed signature and acceptance of the operations carried out.

ARTICLE 6 : PAYMENT

The fact of validating an order implies the obligation for the buyer to pay the indicated price. Payment for his/her purchases is made by credit card using Crédit Agricole's secure system.

ARTICLE 7 : WITHDRAWAL

In accordance with the provisions of Article L. 121-21 of the Consumer Code, the buyer has a withdrawal period of 14 days from the receipt of his/her products to exercise his/her right of withdrawal without having to justify any reasons, or pay any penalties. Returns are to be made in their original and complete condition (packaging, instructions, flyers...). Otherwise, the right of withdrawal could be voided. The return costs are at the charge of the buyer. In case of exercising the right of withdrawal, LE GRAND SIECLE will refund the sums paid within 14 days following the return of the product(s) and via the same means of payment as the one used when ordering.
 
EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

In accordance with the provisions of Article L. 121-21-8 of the Consumer Code, the right of withdrawal does not apply to the supply of goods made to the consumer's specifications or clearly personalized, as is the case with all our made-to-measure products. The buyer is informed that he/she is solely responsible for the choices of dimensions, framing and scale made when ordering, which appear on the assembly plan available in his/her customer account. LE GRAND SIECLE cannot be held liable for this fact.

ARTICLE 8 : AVAILABILITY

Our products are offered as long as they are visible on the website www.legrandsiecle.com and within the limits of available stocks. For products not in stock, our offers are valid subject to availability from our suppliers.

ARTICLE 9 : DELIVERY

The products are delivered to the delivery address indicated during the ordering process, within the time indicated on the order confirmation page. In case of delay in shipment, an email will be sent to the buyer to inform hm/her of any possible impact on the delivery time. In accordance with legal provisions, in the event of late delivery, the buyer has the right to cancel the order under the terms and conditions defined in Article L 138-2 of the Consumer Code. If in the meantime the buyer receives the product we will proceed to its refund, including shipping costs, under the conditions of Article L 138-3 of the Consumer Code. In the event of delivery by a carrier, LE GRAND SIECLE cannot be held responsible for late delivery due exclusively to the unavailability of the buyer after several appointment attempts.

ARTICLE 10 : WARRANTIES

All our products benefit from the legal warranty of conformity and the warranty against hidden defects, provided for by articles 1641 and following of the Civil Code. Any defective or damaged product on arrival is returned and exchanged free of charge. It is up to the buyer to check the product before installing it. Complaints must be made by email to contact@legrandsiecle.com within 30 days of delivery. The products must be returned to us in the state in which the buyer received them with all the elements (accessories, packaging, etc.). The shipping costs will be reimbursed to the buyer on the basis of the invoiced price and the return costs will be reimbursed to the buyer on presentation of the supporting documents. LE GRAND SIECLE is not responsible for hanging problems. The guarantee of our products ends as soon as the hanging is carried out totally or partially. The hanging must respect the uses relating to non-woven wallpaper and the instructions of the supplier of the glue the buyer has chosen. A bad hanging of the wallpaper engages his/her responsibility or that of his/her installer. The provisions of this Article do not prevent the buyer from benefiting from the right of withdrawal provided for in Article 7.

ARTICLE 11 : LIABILITY

The products offered comply with the current French laws. The company LE GRAND SIECLE cannot be held liable in the event of non-compliance with the laws of the country where the product is delivered. It is the buter’s responsibility to check with local authorities about the possibilities of importing or using the products or services he/she plan to order. In addition, LE GRAND SIECLE cannot be held liable for any damage resulting from improper use of the product purchased. Finally, LE GRAND SIECLE cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, including discontinuation of service, and consequences of malicious intents such as phishing and hacking attempts and viruses.

ARTICLE 12 : LAW APPLICABLE IN THE EVENT OF DISPUTES

The source language of this contract is the French language. These conditions of sale are subject to French law. In the event of a dispute, the French courts shall have sole jurisdiction.

ARTICLE 13 : INTELLECTUAL PROPERTY

All content from the www.legrandsiecle.com website is exclusive intellectual property of LE GRAND SIECLE. No one is authorized to reproduce, exploit, redistribute, or use for any purpose whatsoever, even partially, any content of the site, whether software, visual or sound. The commercial use of any simple link or hypertext link is strictly prohibited without the express written consent of LE GRAND SIECLE.

ARTICLE 14 : PERSONAL DATA

LE GRAND SIECLE reserves the right to collect personal information and data concerning any user of its web site. They are necessary to manage orders, as well as to improve the services and information we send. They may also be transmitted to companies that contribute to these relationships, such as those responsible for the execution of services and orders, for their management, execution, processing and payment. This information is stored for security purposes in order to comply with legal and regulatory requirements. In accordance with the law of 6 January 1978, the web site users have the right to access, rectify and oppose personal information and personal data concerning them, directly on the website.

ARTICLE 15 : ARCHIVING OF EVIDENCE

The company LE GRAND SIECLE will archive purchase orders and invoices on a reliable and durable medium constituting a genuine copy in accordance with the provisions of article 1378 of the Civil Code.
